These Terms are the agreement between you and HomeCheck Ltd. They cover what we provide, what we charge, who owns your check-in footage, and where the limits of an automated condition report sit. We have written them in plain English on purpose - a document about evidence should not hide behind jargon. If anything here is unclear, ask us before you sign up.

Agreement to These Terms

HomeCheck Ltd ("HomeCheck", "we", "us", "our") is a company incorporated in England. We operate a mobile-first property condition inspection and reporting service, delivered through our mobile application, website, and any associated portals or APIs (together, the "Platform").

By creating an account, completing a check-in, or otherwise using the Platform, you agree to these Terms and to our Privacy Notice, which together form the contract between us. If you do not agree to them, please do not use the Platform.

You must be 18 or over to use the Platform. If you accept these Terms on behalf of a company, letting agency, or other organisation, you confirm that you have authority to bind it, and "you" means that organisation.

What HomeCheck Does

HomeCheck creates a verified record of a property's condition at a point in time. In practice, that means:

We are neutral, and we do not decide anything. HomeCheck is not a party to your tenancy, not your letting agent, and not a tenancy deposit scheme. We do not hold deposits, adjudicate disputes, or determine whether a deduction is fair. Where a report is shared between a tenant and a landlord, both parties see the same record - neither receives a version the other cannot see.

Access to a property's records depends on your role (tenant, landlord, property manager, or owner) and on the permissions attached to that role. Adding another party to a property means they can see the reports for it.

Your Account

You agree to provide accurate registration details and to keep them up to date. Accounts are personal to you: keep your password confidential, do not share logins, and use a separate account for each individual on your team.

You are responsible for activity carried out under your account. If you believe someone has accessed it without your permission, tell us promptly at hello@homecheck.live so we can help secure it.

Where we grant your organisation access to our API, you are responsible for keeping those credentials secure and for staying within any documented usage limits.

Acceptable Use

The value of a HomeCheck record depends on it being trustworthy. You agree not to:

Your Content and Our Intellectual Property

What stays yours

You keep ownership of the videos, photos, and notes you upload ("Your Content"). To run the service, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, analyse, and display Your Content for the following purposes only:

This licence lasts only as long as we hold the content under the retention periods set out in our Privacy Notice.

On AI training: we improve our models using aggregated and anonymised data only. We will not use identifiable footage of you or your property to train our models without your explicit consent.

You confirm that you have the right to capture and upload Your Content, and that where other people, their homes, or their possessions appear in it, you have given any notice required of you under data protection law.

What stays ours

The Platform itself - our software, computer vision models, report formats, designs, documentation, and the HomeCheck name and branding - remains our property or that of our licensors. We grant you a limited, revocable, non-transferable licence to use the Platform for its intended purpose while your account is active.

The reports you generate are yours to use: you may copy, store, and share them for tenancy, deposit, insurance, and legal purposes without further permission from us.

AI Analysis and What a Report Is Not

Condition scores and item descriptions are produced by automated computer vision, not by a human inspector. No person reviews your footage unless you raise a support issue that requires it.

Automated analysis can be wrong. Lighting, camera movement, obstructed views, and incomplete coverage all affect what the system can see. You are responsible for capturing the property properly, and for reviewing a report before you rely on it. If something is scored incorrectly or missing, tell us and we will look into it.

A HomeCheck report is a record of what was visible on camera at a given moment, and when it was captured. It is not:

No structural assessment, no measurement of value, no professional opinion on the fabric of the building.

🔌 A safety certificate

It does not replace a gas safety record, EICR, EPC, or any other statutory inspection you are required to obtain.

⚖️ Legal advice

Nothing in a report or on this site is legal advice about your tenancy, your deposit, or your obligations.

🧾 A binding determination

We cannot guarantee that any court, tribunal, deposit scheme, or insurer will accept a report as decisive.

You remain responsible for your own legal and regulatory obligations as a tenant, landlord, or agent. Using HomeCheck does not transfer any of them to us.

Plans, Payments and Renewal

Your first check-in is free and requires no card. Beyond that, the Platform is offered on monthly subscription plans:

Prices are shown in pounds sterling and are correct as at the date of these Terms. The current plans and prices are always those displayed on our pricing page at the time you subscribe. Any VAT or other applicable tax will be shown before you confirm your purchase.

Billing and renewal. Subscriptions are billed monthly in advance and renew automatically until you cancel. There is no minimum term and no contract beyond the current month.

How payments are taken. Card payments are processed by Stripe; we do not store your full card details. Where you subscribe through the Apple App Store, the transaction is processed by Apple and Apple's own terms and refund policy also apply to it.

Failed payments. If a payment fails, we may retry it and may suspend paid features until the account is brought up to date. Your existing reports are not deleted because of a failed payment.

Price changes. We will give you at least 30 days' notice by email before any price increase takes effect. It will apply from your next billing date, and you are free to cancel before then.

Cancellation and Refunds

You can cancel at any time, from your account settings or by emailing us. Cancellation takes effect at the end of the period you have already paid for, and you keep access until then. We recommend exporting the PDFs of any reports you may need to rely on before your plan ends.

If you are a consumer in the UK, Ireland, or the EU: you have 14 days from starting a new paid subscription to change your mind and cancel for a refund. If you ask us to begin the service straight away within that period, we may charge you in proportion to what you have used up to the point you cancel. These rights are in addition to, and do not replace, your statutory rights.

Outside the cancellation period, monthly fees already paid are non-refundable, except where the law requires a refund or where we have failed to provide the service with reasonable care and skill. Where you paid through the Apple App Store, refunds are handled by Apple under its refund process.

Nothing in this section limits your rights under the Consumer Rights Act 2015 or equivalent consumer legislation where you live.

Availability, Changes and Pre-release Software

We work to keep the Platform available and reliable, but we do not guarantee uninterrupted access. Maintenance, updates, and occasional outages happen, and some parts of the service depend on third-party infrastructure.

We may add, change, or withdraw features as the product develops. Where a change materially reduces the functionality you are paying for, we will give you reasonable notice and you may cancel.

Pre-release builds. Some versions of the HomeCheck app are distributed in pre-release form, including through Apple TestFlight. Pre-release software is provided as-is: it may contain defects, features may change or disappear, and it is not covered by any service commitment. If a record matters to you, export and keep your own copy of the report.

Suspension and Termination

You may close your account at any time by contacting us at hello@homecheck.live.

We may suspend or terminate your access where:

Except in cases of serious breach, unlawful use, or a legal requirement, we will give you reasonable notice and, where the problem can be fixed, an opportunity to fix it before we terminate.

On termination, paid features stop. You may request an export of your reports before your account closes, and we retain or delete your data in line with the retention periods in our Privacy Notice - inspection records are generally kept for the duration of the relevant tenancy plus six years, because that is how long a dispute about it can realistically run. Sections 5, 6, 11, 13, and 14 continue to apply after termination.

Disclaimers and Limitation of Liability

We will provide the Platform with reasonable care and skill. Beyond that, and to the extent permitted by law, the Platform is provided without further warranties - in particular, we do not warrant that automated condition scores will be complete or error-free, or that any third party will accept a report as decisive.

We are not responsible for the outcome of a deposit dispute, tribunal or RTB claim, insurance claim, or tenancy decision, nor for how you or another party choose to use a report.

What we never exclude. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. If you are a consumer, your statutory rights are unaffected.

Subject to that, we are not liable for indirect or consequential loss, loss of profit, business, contracts, goodwill, or anticipated savings; and our total liability to you for all claims arising in any 12-month period is limited to the greater of the fees you paid us in that period or £100.

If you use the Platform as a business (including as a landlord, agency, or property manager acting in the course of business), you accept that any terms implied by statute are excluded to the fullest extent the law allows, and that this section reflects a fair allocation of risk given the price of the service.

Data Protection

How we collect, use, share, and retain personal data is set out in full in our Privacy Notice, which complies with the UK GDPR and the EU GDPR. It forms part of these Terms.

HomeCheck Ltd is the data controller for the account and Platform data described in that notice. If you use the Platform in the course of your own business - for example a landlord or agency documenting a tenant's home - you may also be a controller of the personal data you handle through it, and you are responsible for meeting your own obligations, including telling occupants that a video record is being made.

Complaints, Governing Law and Disputes

If something has gone wrong, tell us first at hello@homecheck.live. We aim to acknowledge complaints within 5 working days and to resolve them within 30 calendar days.

These Terms, and any dispute arising out of them or the Platform, are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.

If you are a consumer resident in Ireland, the EU, or elsewhere in the UK, you keep the benefit of any mandatory consumer protections that apply where you live, and you may bring proceedings in the courts of your own country.

General Terms

Changes to these Terms

We may update these Terms to reflect changes in the Platform, the law, or our practices. When a change is material we will update the "Last Reviewed" date above, notify registered users by email or in-app notification at least 14 days before it takes effect, and keep an archive of prior versions available on request. Continuing to use the Platform after that date means you accept the updated Terms.

Third-party services

The Platform relies on third parties including Microsoft Azure (hosting and computer vision), Stripe and Apple Pay (payments), and the Apple App Store (distribution). Their own terms govern their services, and we are not responsible for them.
